A court ruling has opened the door for Florida public-school students to challenge rules on reciting the pledge of allegiance.

A former Palm Beach County high school student's desire not to stand during the pledge of allegiance was supported by a federal appeals court this week though the court wouldn't go as far as to say that means every student in Florida is exempt from standing during the school-day ritual.

But the ruling by the 11th Circuit Court of Appeals in Atlanta could trigger more lawsuits if other students are forced to stand for the pledge or punished if they do not, said Randall Marshall, an American Civil Liberties Union attorney who represented Cameron Frazier.

What's different about Cameron Frazier than any other student in the state of Florida? Marshall said.

Frazier was a junior at Boynton Beach High in 2005 when he refused to stand during the pledge and spent the rest of the day in the office after his teacher berated him for his disrespect, according to the original lawsuit.

Frazier did not have his parents' permission to abstain, but the teenager said he had not stood for the pledge since the sixth grade.

The appeals court upheld another Florida law that requires kids to get permission from their parents before abstaining from the pledge, reversing a lower court's ruling on that matter.

In a prepared statement, Florida Education Commissioner Eric Smith said the state Department of Education was pleased that the court 'recognized the balance between the exercise of free speech and parents' right to direct and oversee their child's education and civic values.

The department and the state Board of Education, along with Frazier's teacher, other school employees and the Palm Beach County school district, were the defendants in the original case. Frazier settled with the district in 2006 but pursued his case against the state.

In 2006, a federal judge ruled that the state law requiring civilians to stand during the pledge, and another requiring students to get written parental permission to avoid participating, were unconstitutional. The state appealed.

In his statement, Smith wrote that the state Board of Education and Department of Education were seeking to defend the constitutionality of the statute.

South Florida teachers who learned of the ruling Thursday had mixed reactions.

Ron Beasley, a teacher at W.R. Thomas Middle School near Tamiami and a retired Army Airborne Ranger, said he had no problems with his students sitting during the pledge, as long as they discussed it with him first.

If a kid has told me that he or she doesn't believe in acknowledging the flag or it's a religious issue, I don't push it, he said. But for the other kids who have not expressed some specific objection, it is a matter of respect and patriotism. They should be there for the pledge.

The pledge of allegiance must be recited once a day at public schools, according to a 1942 state law.

When the school district settled with Frazier, it also chose to follow federal law, which does not require standing during the pledge or written parental permission to avoid it.

Broward school district spokesman Keith Bromery said students do need to bring in a note from their parents to be exempt from participating in the pledge.

If somebody does not want to do it, it's their right to opt out, Bromery said. They cannot disrupt the procedure.

The Miami-Dade district does not require a note from parents, said Martha Montaner, administrative director for school operations.

The students who choose not to participate, either because of a deep personal conviction or religious reasons, can stay silent or sit down until the activity is over, Montaner said. We give the students the liberty to choose.

Students are not required to stand, she said.

Montaner could not say whether the district's policy would change in light of the ruling.

Frazier, who has not commented publicly about his suit, said he did not want to stand for the pledge because of his personal political beliefs and convictions, the original lawsuit states.

LAKE BAIKAL, Russia - A Russian mini-submarine on Tuesday reached the bottom of Lake Baikal in Siberia, setting a world record for the deepest dive in a lake, the crew told organisers from the vessel.
"Mir-1 is at 1,680 metres" (5,512 feet), a crew member could be heard saying in a radio link-up with a special barge near Olkhon Island that had lowered the Mir-1 and Mir-2 submarines into the waters of the world's deepest lake.
Lake Baikal was previously believed to be a maximum of 1,637 metres deep and scientists say they could find new life-forms in its unexplored depths.
"This is a world record for a submarine diving in fresh water," an expedition organiser was quoted as saying by the Interfax news agency.
The scientific expedition was organised by Artur Chilingarov, a pro-Kremlin member of parliament and an Arctic explorer who led the submarine team that planted a Russian flag at the bottom of the North Pole last August.
Scientists plan to collect samples at different depths and hope to document the effects of global warming on the pristine lake, as well as to draw the attention of the government to the need for greater environmental protection.
"We want to study and observe Baikal, preserve it," Chilingarov said on Monday ahead of the dive as he inspected the mini-submarines in the small fishing port of Turka on the mountainous eastern shore of the lake.
The expedition also has a political dimension. Chilingarov said he had "full support" from Prime Minister Vladimir Putin and a flag for the ruling United Russia party could be seen flying proudly from the expedition's barge.
Lake Baikal is the deepest lake in the world, although not the largest in terms of surface area. Environmental groups warn that increased pollution is threatening the lake, which has more than 800 unique wildlife species.
The lake contains around a fifth of the world's freshwater reserves.

It looks like Barack Obama is narrowing his search for a vice president, and Hillary Clinton ain’t on the list. There are reports that Virginia Governor Tom Kaine is quote “very, very high on the short list” and that he’s told associates he’s had “very serious conversations” with Obama about joining the ticket.
Some of the other names out there are Senators Evan Bayh and Joe Biden, Kansas Governor Kathleen Sebelius and former Senator Sam Nunn. But no Hillary. She may dream about being on the dream ticket, but that’s apparently about all.
Right after the primaries CNN’s Roland Martin told me the chances of Hillary being on the ticket were slim and none. When one of our bosses told him he needed a second source for that information, Roland said, “There is no second source.” Looks like he knew what he was talking about.
The New York Times says Clinton has told people close to her she thinks there’s little chance Obama will pick her. Here’s a clue: She hasn’t been asked to provide any documents to the committee vetting potential VPs. She’s not campaigning for Obama either.
Hillary Clinton hardly darkened the door of the U.S. Senate for 16 months while she was running for president.
Now all of a sudden her former campaign chairman Terry McAuliffe says she’s been too busy working in the Senate to campaign for the Democrat who won the nomination. He says once she’s done there, though, “she’s going to hit the campaign trail.” Her Senate work didn’t keep her from campaigning for herself almost every day for a year and half.
And what about Bill Clinton? Almost as silent and invisible as his wife.

U.S. providing rocket defenses to Israel, official says - -
WASHINGTON — The United States will provide Israel with the X-band radar system used to detect and track missile launches as part of a package of assistance aimed at beefing up Israeli defenses against missile and rocket attacks, a senior Pentagon official told CNN Tuesday.

The official, who spoke on condition of anonymity, said the U.S. assistance will include an agreement to facilitate the sharing of U.S. “early warning” launch data and technical and financial help developing defenses against shorter range rockets and mortars.

The help was announced after Israeli Defense Minister Ehud Barak met with Defense Secretary Robert Gates on Tuesday.

NESS CITY, Kan. - A man whose girlfriend sat on a toilet for so long that the seat adhered to her body will spend six months on probation.
Kory McFarren pleaded no contest last month to a misdemeanor count of mistreatment of a dependent adult. A judge sentenced him Tuesday to six months in jail but granted the probation after the victim, Pam Babcock, asked for leniency.
"She didn't believe that her circumstances were his fault," Ness County Attorney Craig Crosswhite said.
Babcock's plight became known in February when McFarren called the Ness County sheriff, expressing concern about his live-in girlfriend. When authorities arrived, they found Babcock physically stuck to the toilet.
McFarren told police Babcock had refused to come out of the bathroom for two years. Medical personnel estimated she'd been sitting on the toilet for at least a month and said the seat had adhered to sores on her body.
She is now under the protection of a guardian who was appointed through the legal department at the hospital where she received treatment.
Also Tuesday, McFarren was sentenced to six months in jail for an unrelated charge of lewd and lascivious behavior for exposing himself to a teenage neighbor in March.

California judge rules early cell phone termination fees illegal.........
In one of the most significant legal rulings in the tech industry this year, a Superior Court judge in California has ruled that the practice of charging consumers a fee for ending their cell phone contract early is illegal and violates state law.

The preliminary, tentative judgment orders Sprint Nextel to pay customers $18.2 million in reimbursements and, more importantly, orders Sprint to stop trying to collect another $54.7 million from California customers (some 2 million customers total) who have canceled their contracts but refused or failed to pay the termination fee.

While an appeal is inevitable, the ruling could have massive fallout throughout the industry. Without the threat of levying early termination fees, the cellular carriers lose the power that's enabled them to lock customers into contracts for multiple years at a time. And while those contracts can be heinously long, they also let the carriers offer cell phone hardware at reduced (subsidized) prices. AT&T's two-year contract is the only reason the iPhone 3G costs $199. If subsidies vanish, what happens to hardware lock-in? Could an era of expensive, but unlocked, hardware be just around the corner? It's highly probable.

Of course, the carriers aren't going to take this lying down. Early termination fees are seen as critical to business, so carriers are expected to look for ways to reclassify the fees (such as by calling them "rates," part of the arcane set of laws that covers the telecommunications industry). The industry is also pushing for the federal government to step in and claim oversight over the early termination fee issue, which would invalidate any state ruling. The FCC is generally more tolerant of such fees, though Chairman Kevin Martin has proposed a plan whereby the fees are decreased the closer you are to the end of your contract.

The FCC may also buy the argument that, since carriers are nationally based (and consumers can use their phones anywhere in the country), that a single policy should apply across the nation, rather than creating a patchwork of legislation that could lead to confusion and chaos caused by having 50 different policies.

NASA says Mars craft "touched and tasted" water....
LOS ANGELES - NASA scientists said on Thursday they had definitive proof that water exists on Mars after further tests on ice found on the planet in June by the Phoenix Mars Lander.
"We have water," said William Boynton, lead scientist for the Thermal and Evolved-Gas Analyzer instrument on Phoenix.
"We've seen evidence for this water ice before in observations by the Mars Odyssey orbiter and in disappearing chunks observed by Phoenix last month, but this is the first time Martian water has been touched and tasted," he said, referring to the craft's instruments.
NASA on Thursday also extended the mission of the Phoenix Mars Lander by five weeks, saying its work was moving beyond the search for water to exploring whether the red planet was ever capable of sustaining life.
"We are extending the mission through September 30," Michael Meyer, chief scientist for NASA's Mars exploration program, told a televised news conference.
The extension will add about $2 million to the $420 million cost of landing Phoenix on May 25 for what was a scheduled three-month mission, Meyer said.
Phoenix is the latest NASA bid to discover whether water -- a crucial ingredient for life -- ever flowed on Mars and whether life, even in the form of mere microbes, exists or ever existed there.
Phoenix touched down in May on an ice sheet and samples of the ice were seen melting away in photographs taken by the lander's instruments in June.
Boynton said that water was positively identified after the lander's robotic arm delivered a soil sample on Wednesday to an instrument that identifies vapors produced by heating.
Mission scientists said the extension would give time for more analysis of Martian samples. They plan to dig two additional trenches -- dubbed "cupboard" and "neverland" -- using the robotic arm on the Phoenix craft.
"We hope to be able to answer the question of whether this was a habitable zone on Mars. It will be for future missions to find if anyone is home on this environment," Phoenix principal investigator Peter Smith told the news conference.
Mission scientists said in June that Martian soil was more alkaline than expected and had traces of magnesium, sodium, potassium and other elements. They described the findings as a "huge step forward."
Meyer said the scientific proof of the existence of water meant that Phoenix could "move from looking for water to seeing whether there were habitats for life.
"We are moving towards understanding whether there were or could be places on Mars that are habitable," Meyer said.

They gave me a Rewards Card several years ago. The last time I used it was 2-years ago to buy a TV, it worked fine. The card is tied to your email account, even though it has a rewards member number.

However I didn't know it was tied to an email address. Thus I went to use the card and they informed me of the problem. Best Buy claimed they transferred all the points to the new card - that's bullshit.
Every 1,000 dollars is worth a $20 coupon. I am looking to buy a video camera and they can't find all the points I spent over the last two years.

Make things worse the customer service rep is out sourced to Mexico. The idiots don't even speak English.

So Best Buy I will purchase my Video camera online and not at your store.

I'm not a lawyer, but I work with civil law in a variety of ways.

Basically, civil law is citizen against citizen. Criminal law is state against citizen.

With civil law, you can not be found guilty (i.e., you will not be imprisoned or penalized by the state in any way). With civil law, you are found responsible (which means you are financially responsible for damages you may have caused/debts you may have incurred to an individual, group or company).

With criminal law, you are not responsible; you're either guilty or not guilty. If you're guilty, the state can imprison you or penalize you monetarilly (depending on what you're guilty of).
